The woman found out that saline implants have a higher risk to break than silicone implants and that this manufacturer has also a higher rate of breaking implants than other manufactures. Although it can be very difficult for a customer sometimes to win a product liability case, this one was settled out of court.
Another case was even more tragic. A woman did check for breast cancer every half year because of a family history of cancer. What she did not know was that the machine the doctor did use was not working properly. When they found the cancer it was too late already. If the device would have worked correctly then the cancer could have been detected much earlier. Who is responsible? The doctor, the hospital, the company manufacturing the device?
Product liability law can be different from state to state and it is important to choose an attorney in your state of incorporation or living. The attorney must be specialized in the are of your business and should have some experience with similar cases already.
