<p>The U.S. Food and Drug Administration (“FDA”) is one of the country’s oldest consumer protection agencies. The FDA’s purpose is to promote and protect the public’s health by trying to ensure that safe and effective products reach the market; to monitor products for continued safety after they are in use; and to help the public get accurate, science-based information regarding health issues.<br />
The Center for Devices and Radiological Health (“CDRH”), a division of the FDA, must approve a medical device before it can be marketed to the general public.  The CDRH is responsible for testing and approving every medical device to ensure that it is both safe and effective.  The CDRH may discover a defect that prevents approval.  If the device is approved and a defect is then discovered, the FDA may request a voluntary recall by the manufacturer or issue a recall if the manufacturer refuses to comply.</p>
<p>Injury or loss may be caused by a medical device.  An individual person who has been injured using a medical device may be able to sue the manufacturer, wholesaler, company or person that sold the product for damages. A lawsuit can be brought against any person or company that was involved in producing or distributing the medical device.  There are three main categories in which evidence can be shown to prove a device is defective:</p>
<p>•    Design defect-There is a flaw in the conceptual design of the device.</p>
<p>•    Manufacturing defect-There is a specific defect which occurs during the manufacture of the device.</p>
<p>•    Warning defect-The device is not accompanied by adequate or reasonable warning or there has been a failure to educate the consumer at to potential and latent dangers regarding the device.</p>
<p>In some cases, the manufacturer of a medical device will clearly inform the physician community about the risks of a device and it then becomes the obligation of the physician to communicate those risks to the patient.</p>
<p>These cases are subject to a statute of limitations which is the fixed period of time in which a person must file a claim.  The statute of limitations usually begins when the patient’s illness or injury is discovered, rather than when the injury happened.<br />
If a manufacturer, wholesaler or company that produced or sold the device is found at fault, a court can order them to pay damages.  Depending on the state where the injury occurred, the following damages may be allowable:</p>
<p>•    Economic damages: Compensation for monetary losses such as past and future medical expenses, loss of past and future earnings, loss of employment or business opportunities.</p>
<p>•    Non-economic damages: Compensation for subjective, non-monetary losses such as pain, suffering, inconvenience, emotional distress, loss of society and companionship, loss of consortium, and loss of enjoyment of life.</p>

<p>Trampolines come with a variety of accessories and sizes. One of the required accessories is a cover for the springs. The cover protects the user from being pinched and/or falling in between the springs. An optional accessory is a net that goes around the trampoline. The net protects the user from falling off the trampoline. A super trampoline is another type. This type of trampoline allows the user to jump over two feet high and defy gravity. The system can have one to six stations available for use.</p>
<p>To safely use a trampoline a child should have an adult supervise them while using the product. The trampoline should have one user at a time. When multiple users are on a trampoline it increases the chance of injury. The trampoline must be placed in a safe location that is not near an object where a user can be injured. Before a child is allowed to use the trampoline parents must set rules for proper use. The parent should also discuss the possible consequences and injuries if the child does not follow the rules. Common injuries include sprains, broken arms/legs, minor head injuries, broken necks and spinal cord injuries. Injuries can result from landing improperly, striking another user, falling off the trampoline or even falling in between the springs.</p>
<p>This is one type of case that I have assisted on. A child was injured by using a super trampoline at a event planned by the employer. On this case I assisted the plaintiff to prove the defendant was negligent. The defendant continued to use the super trampoline after it had been damaged. <p>We use and consume products on a daily basis in all areas of our life. We are entitled to expect the best from these products; we expect them to be safe and to not cause us harm.</p>
<p>Trading Standards receive around 33,000 complaints each year regarding unsafe products. 4,793 prosecution cases were brought under the safety provisions by trading standards authorities during the ten year period ending 31st March 1998 as reported to Parliament 95% of these cases were successful and fines imposed during the last five year period averaged just over £600.</p>
<p>In order to make a successful personal injury claim you need to prove another person was responsible for your injury. In the case of defective/faulty products you have to be able to show the actually defect in the product and how it is a result of your injury.</p>
<p>In 1987 the Consumer Protection Act came into force. The reasoning behind this act was to make it easier to pursue a claim against a manufacturer. The Consumer Protection Act 1987 has been used many times; whether it is against a large pharmaceutical company or a small business manufacturer.</p>
<p>The Consumer Protection Act covers all goods including ones used in workplaces/food/building material and agricultural needs. Defective Cosmetic products are another thing that the act covers. You have to be careful when purchasing cosmetic products to ensure you are not allergic or sensitive to any of the ingredients. Soaps, shower gels, hair-dye, make-up and perfume can all cause reactions if you are not careful. <p>There are four main types of compensation claim that can be made under the existing Consumer Protection Act; these are:</p>

<p>• Failure to recall: a manufacturer finds fault with a product but fails to recall product</p>

<p>Common faulty product complaints lie in electrical appliances such as kettles, toasters, lamps and hair dryers; these products if faulty can cause burning, shocks or could even explode leaving devastating results.</p>
<p>Another common complaint comes from faulty toys. The safety in the manufacturing of toys if one of the highest as if anything goes wrong it will be a child that suffers because of it.<br />
There are certain steps that can be taken to ensure the standard of our consumer products:</p>
<p>• Product safety system itself must be better managed.</p>
<p>• Greater attention should be paid at the design stage to ensure products are safe and companies should integrate product safety within their management system.</p>
<p>• Manufacturers are more likely to ensure their products are safe if they see others punished for putting dangerous products on the market.</p>
<p>• More effective market surveillance needs to be employed and valid product liability claims need to be better supported.</p>
<p>• With limited resources available to both manufacturers and the enforcement authorities, choices have to be made and priorities set. Risk assessment techniques should be more widely used to assist in this process.</p>

<p>There are very often cases of product liability in the medical sector. As an example, there are thousands of breast implant surgeries performed every week, usually with silicone but more and more also with saline filling. One of the biggest concerns of the women is, of course, that the implants break and leak.</p>

<p>Another case was even more tragic. A woman did check for breast cancer every half year because of a family history of cancer. What she did not know was that the machine the doctor did use was not working properly. When they found the cancer it was too late already. If the device would have worked correctly then the cancer could have been detected much earlier. Who is responsible? The doctor, the hospital, the company manufacturing the device?</p>

<p>Product liability is a law that surrounds you each and every time you use something that has been produced or manufactured for the public. It ensures that the product or food is held to a certain standard.
