A significant increase in people who are now prepared to make fraudulent personal injury claims to supplement their income.

An astonishing eighty nine percent of lawyers believe that the No Win No Fee arrangement has encouraged more people to make deceitful injury claims, according to research carried out by LV.

Overstating injuries has been on the rise for the past 10 years say almost sixty percent of the solicitors involved, with almost half stating they have witnessed a surge in false claimants since the start of the recession.

The most common types of injury that are likely to be embellished are whiplash, post traumatic stress disorder and strained muscles, with car accidents being the favourite choice of incident for these injuries to occur.

The LV investigation established that sixty three percent of the legal professionals believe that television advertising of these kinds of services is one of the key factors for the increase in false injury claims, they also believe that those involved do perceive it as an easy way to make money.

As a consequence of these actions, sixty two percent of lawyers now scrutinise in much greater depth the submitted personal injury claim forms before committing to any further action.

One law firm specialising in the investigation and handling of suspected fraudulent personal injury claims on behalf of insurance companies echoes what is being said by LV and confirms that the experience of their own fraud unit is that some types of insurance fraud are now reaching epidemic proportions.

Let there be misunderstanding here, personal injury claims fraud is not a faceless crime; there is a direct link to the rise in fraud perpetrated by dishonest people and the extra you have to pay out of your own pocket and if we cite one example from LV then you are now one hundred pounds per year worse off due to the increase in car insurance premiums.

Martin Milliner, LV technical claims director, said: Legitimate cases of personal injury where another person or company is to blame are certainly a cause for recompense. However, drivers who concoct or exaggerate their injuries to make a claim not only break the law but also push up the cost of car insurance premiums for all motorists. We support all solicitors to continue to apply thorough questioning to anyone claiming a personal injury, and to investigate very carefully any concerns they have about the dependability of any claim.

By Peter Norman -

Personal injury claims refer to the case filed by the person known as a plaintiff against the defendant in order to get assistance by him on any physical or psychological injury caused by the negligence of the defendant and causing harm to the claimant. There are many reasons on which you can file a case: hit by a car, slip in front of somebody’s house due to icy sidewalks and fall down in the gutter or bitten by anyone’s pet animal. Because all these incidents caused a sort of harm to you, you can claim a personal injury if you can prove your case in the court.

The process of personal injury claim depends on the expense of the world you are living in. This term is very popular in the European countries where neither the process is lengthy nor fee of the case is very high. A moderate person can afford it very easily.

You can also seek legal assistance if you cannot settle the case of personal injury claims or if your case is too complex to handle. But you will have to be patient. Although the process is not lengthy but it takes some time to settle down the matter. If you are not in a position to pay even a reasonable amount of price free legal assistance is available in European countries. If you are willing to pay the fee of your case then the things which cost you are the notification letters, attested documents of your accidents, files proving that your injuries are not fake, letters required by the court from you or your insurances company if you have insured and most importantly the fee of the lawyer and solicitors. The fee is almost equal everywhere.

People in question have to pay numerous visits to the police stations in order to be heard. All those who can afford to pay for the injury or damage prefer not to indulge in personal injury claiming because of this. Keeping in mind the busy life of people, they do not have enough time to run after all this stuff.

Also there is no free legal assistance and the amount given to the lawyers is very high. For example, if you are claiming two hundred thousand in the defendant you will have to pay minimum of twenty thousand rupees just to speed up the process for the first hearing. Other expenses for documentation and files required by the court are there as well.

The benefit of personal injury claim is to avoid the same accident which occurred to you in the future. For example, you were driving a car and your car fell down from a bridge because there was no barrier on its side, you can file a case against the persons responsible for such harmful carelessness in order to save other people’s lives.

If the system is efficient, then the personal injury claim is not expensive; however in a corrupt society the case is opposite.

Peter Norman is helping others to get a personal injury claim.

By Hermie Martin -

If you suffer from an injury that is not your fault to begin with, you may be qualified to file for personal injury claims, and the best thing about this is that you may even do this on a no win, no fee basis. There are actually a variety of compensation packages for the different types of accidents. Sometimes, it may surprise you to know that even injuries which you think are so silly in nature can be duly compensated for.

A lot of workplace accidents such as slipping on wet floors, breaking a leg, falling off a ladder, and so on, happen because of negligence, lack of training, misuse of equipment and the like — and these injuries can be avoided by taking the necessary safety precautions and measures.

The thing is, as long as it can be established that the injury is not your own doing, you can always file a compensation claim. After all, when you suffer from an injury you naturally will seek medical treatment, and you know how expensive everything is these days! Worse, if the injury is serious, you may even lose your job, and that means lost income.

It therefore helps to know that you can file for personal injury claims to compensate for your loss. There are many companies that deal with this kind of thing, and very often it’s difficult to know the honest ones from those that are only after making money from your case.

Whether you choose a local solicitor or a claims company operating nationwide is not as important as ensuring that you are in good hands. See to it that your solicitor or the claims company has the qualifications, the skills, and the experience to help you through it all. Do check if your solicitor or choice of claims company has easy access to medical experts because apparently in personal injury cases, medical advice or consultation will be sought.

In the event that you suffer from personal injury, it is always a good thing to check if you are qualified to make a claim. If you are, do the next best thing — get a good solicitor to represent you. Usually, it does pay to seek professional in this case. As you must know, not everyone wins in compensation claims. Some people even have to make do with a small amount, if they are compensated at all, because they are not well represented.

Moreover, if you insist in doing things your own way, you must expect that it is not going to be easy. These things usually require professional help in the form of personal injury claims solicitors. Don’t worry, there are now no win no fee solicitors, which means that you don’t need to spend any money to pay for their services. You have to be honest, though, in providing the necessary information because solicitors of this kind only accept cases which they feel will win. If you indeed get someone to represent you and you win, the insurance company of the losing party will be the one to pay for the services of your solicitor.

In our childhood, the marks “earned” on the sports field were especially valuable, as they were testaments to the toughness of the person and were carried around as trophies. However, today, if we are injured due to our own carelessness or oversight, we just need to accept it and move forward. But living in a social setting in which we need to interact with a large cross section of people every day, it is possible that we incur a personal injury due to someone else’s negligence or plain carelessness. For such situations, legal recourse is open to us.

Injury Claims

There are various sections under the law that deal with specific types of injuries, such as workplace injuries or car accident injury. Each of these has its own set of components, but if you incur an injury that is not covered under any of these specialised sections, you can obtain the help of a personal injury solicitor to file for a simple injury claim. Such claims include:

•Workplace injuries suffered by persons other than employees (e.g. contractors or labour hire workers);
•Injuries caused by negligent medical treatment;
•Injuries caused by defective products;
•Injuries suffered on private property (e.g. injuries caused to a tenant by a defective rental property);
•Injuries suffered on public property (e.g. a fall in a public place).

Damages Compensation

Damages compensation for such claims is usually made up of a number of different components, including:

•Pain, suffering and loss of amenities;
•Out of pocket expenses;
•Future out of pocket expenses (such as future surgical costs, ongoing physiotherapy, home services, such as lawn mowing, etc);
•The income you have lost since the incident;
•The income you are likely to lose in future because of the personal injury;
•Unpaid care and assistance (payment for time spent by loved ones in caring for you due to the effects of the incident, subject to meeting certain criteria).

Personal Injury Lawyers

If you are looking to file a claim for injuries incurred, it is advised to obtain the help of personal injury lawyers that are experts in the field of claims. Turner Freeman, based in Queensland, have been providing legal services to people looking to file for injury claims for a number of years. They specialise in the field of injury claims, motor vehicle injury claims, workplace injury claims, mesothelioma claims and other legal issues, such as wills and estates.

By Nicholas Tate

According to the Pedestrians Association, one in five pavements throughout the UK are suffering from some form of deterioration. It is this deterioration to UK pavements which has caused a significant number of accidents and injuries to pedestrians each year. Pavements which are dogged by cracks, pot holes and raised paving slabs pose a huge trip hazard to people of all ages, but children and old people in particular.

If you are unfortunate to have had a trip on a public pavement due to a defect with the pavement, you could be entitled under UK law to make a personal injury compensation claim. To be eligible to make a pavement accident claim, the accident must have caused you to suffer some form of personal injury. Generally speaking the injury must last for at least four weeks in order to make a successful personal injury claim.

Injuries caused by pavement accidents are estimated to cost over £500 million each year, which is a huge amount of tax payers money. However, the cost to repair these pavement defects would be significantly higher, so there is somewhat of a catch 22 situation. Most councils do have some form of inspection and maintenance program in place to highlight potential problems. However, there are so many defects on UK pavement that not all can be fixed at once, leaving many pavement defects untouched for months, if not years.

Pavement accidents can cause a wide range of injuries. Some of the common injuries caused by such accidents include foot, ankle and knee injuries and back and neck injuries. Injuries to the hand, wrist and arm are also common due to the natural instinct following a trip to put your hands out to protect yourself. Whilst this can help to protect you from head and facial injuries, unfortunately your hands, wrists, elbows, arms and shoulders then take the brunt of the fall.

If you have had an accident on a public pavement you should contact a personal injury solicitor for some free advice. A specialist personal injury solicitor will be able to let you know whether or not you have a potential claim, and how much compensation you could be entitled to.

Nicholas Tate manages a number of personal injury websites which provide information on all types of no win no fee claims, including pavement accident claims, medical negligence, whiplash claims and slips and trips.

When filing a personal injury claim there are no guarantees that you will win, but you can strengthen your chances of success by gathering and documenting information regarding all aspects of your case. Proving the negligence of another party has to be done based on facts, and this is where documentation is most crucial.

If you have been injured, getting compensation for your injuries will require that you document everything beginning from the time that the injury occurred, up until your case is resolved. The most efficient means of documenting your case is by:

Getting a copy of the accident or injury report- Reports provide the foundation for your case and give an authoritative third-party assessment of what occurred. Police reports are widely considered to be the best types of report and include a legally accepted recount of the accident and normally identify which party was at fault.

Get witness statements- Aside from an official report, getting witness statements is another great way to build up your case and provide evidence as to the nature and severity of your injuries and how they occurred. These witnesses may also be called into court if necessary to substantiate your claims.

Keep all evidence- In-depth documentation is essential to your personal injury claim and will also help your lawyer to build a case. Keep all police and accident reports, receipts for expenses that you have incurred as a result of your injuries, including medical bills. Photos and videotapes are also ways in which you can document your case.

Seek medical attention- Going to the doctor is important so that you can get the medical attention you need and to have your injuries evaluated by a professional who will also be able to confirm whether or not your injuries were caused by the accident.

Seek legal help

Filing personal injury claims can be a costly and timely undertaking that can tax even the most patient person. Seeking the advice of a personal injury lawyer can help you establish if you have a case that is viable.
